You must read and agree to these terms to commission me. If you do not read the terms you are still required to follow them; I will not be responsible for your failure to read them. Please read over these terms every time you commission in case there have been changes!
Terms can sound aggressive as they are in place to protect me as a professional worker, however, I am very reasonable and understanding. PLEASE always feel free to talk with me about anything you don’t understand or something you want clarification on, as well as ideas you have for commissions that aren’t listed. Terms of Service

Do not copy/trace/repost any of the work I produce under any circumstances without permission if you are not the commissioner.
Remove my watermark/signature under any circumstances on any work I produce without permission.
You have the right to use your commission in any way non-commercially.
You may use the work commercially ONLY if we have come to an agreement for commercial use.
Only I and the commissioner (or current owner of the depicted subject(s) ) may use artwork produced for them. Even if you did not commission the artwork you are still required to follow these terms.

- Sell my artwork in any way or use it commercially. (ie. on pins, merchandise, & anything else to be sold) unless agreed upon.
- Remove my watermark/signature under any circumstances on any work I produce without permission.
- Claim the art as yours.

Once contacted for a commission, I will provide a sketch (still image/s) or storyboard (animations) for approval.
If the work is an animation over 30 seconds I will charge for the storyboard based on complexity (all approval stage work created will have large watermarks on them and are for approval purposes only until paid for, in which I will provide you with the full files with a small watermark in the corner if you ask for these files).
Please only consider commissioning if you are serious about one, however always feel free to ask for a quote!
I have the right to decline a commission for any reason.
Deadlines

As a professional, I am very capable of working with deadlines. If you have a deadline please feel free to discuss it with me, setting deadlines may result in extra charges depending on time frame.
Commissioners who pay for short notice deadlines will have their work prioritized despite my queue.
Quotes
__________
Quotes are estimates of how much you would be paying for a specific piece. This is meant more for when you feel a design might be charged extra, you are requesting a deadline, or if what you had in mind is not clearly stated on the price list. However, you should have a basis of what you are expecting. I.E. “ I would like a flat color with an animated element” . Send quote requests to bmaugeriart@gmail.com.
If you have a certain amount of money you have in mind to spend, state it in the email when asking for the quote. This will help me figure out what kind of work you are looking for that best fits your budget.
Payment

Payments are only in USD.
Commissions under $150 must be paid before I will start them.
Commissions $150+ will require a 50% down payment which must be paid before I begin. The other 50% of the cost can be paid upon my completion.
I may charge extra If I feel that any part of a commission is too complex, i.e. character design or background / details.
I accept payments through PayPal and Venmo only at this time. For long term or large freelance projects feel free to discuss multiple payment methods.
For large scale projects, payment plans can be arranged.
Refunds and Cancellations

If you need to cancel a commission at any time, please let me know as soon as you need to cancel.
I require 72 hours to issue a refund after it has been requested.
Commissions that have not been started can get a 100% refund.
If you cancel your commission after work has been completed, you will only be given a refund proportionate to the amount of work not completed. All art files will be given to the commissioner upon cancellation when relevant.
I will not issue any refunds after the full work has been completed.
Charge-backs of any type will result in a permanent ban from all future commissions.
Abusive behavior to me will result in immediate cancellation of your commission.
Upon issuing a charge-back the client should be able to prove some sort of negligence, neglect, & loss of communication on my part regarding a manual refund. I keep dated logs of all communication between every client and I.
- If using a charge-back to void my refund policy the following actions will be taken:
The client's rights to the product in question will be forfeited. The product may be resold or utilized in other ways as compensation.
The client will be subject to public blacklist to warn fellow freelancers of their charge-back.
Promoting myself/Privacy fee

I reserve the right to promote myself with any work I produce.
This includes sharing files and process work to sites such as Patreon.
If you would like me not to show/share the work you commission from me it will be an additional 20% of the total cost of your commission added on to the final price as a privacy fee. This must be paid up front before I will begin.
If what you are commissioning from me is a surprise for someone/something please discuss this with me and I will not post anything having to do with it until it’s intended viewer(s) have seen it. You do not have to pay the privacy fee in this scenario. You must however communicate with me that it is safe to post. You have 6 months to communicate this with me after I deliver the final product to you. If you fail to communicate this with me after 6 months I reserve the right to share the work.
If you need a longer amount of time please discuss it with me.
Communication

I will not be held accountable for your lack of communication with me.
If something is unclear to me I will ask for clarification, If you fail to respond to me, that is on you and may result in an incorrect delivery.
Some things I will not be able to continue with if not properly clarified, this can cause late delivery.
DO NOT give me ridiculous deadlines like “I need this in 30 minutes” and expect this to be something achievable unless we have established that I am in a position to pump out quick work. I am not always at a desk or with my computer so please understand this.
I will not tolerate “you didn’t add (blank)” or “why didn’t you put (this)?” etc. if you fail to communicate with me.

The only info I will post publicly when posting your commissioned work will be your name or @ unless asked otherwise.
Before or at the time of collecting personal information, I will identify the purposes for which information is being collected.
I will collect and use personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
I will only retain personal information as long as necessary for the fulfillment of those purposes.
I will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
